Terms of Service
01Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Loktra ("Loktra", "we", "us") governing your use of the Loktra Android application and related services (the "Service"). By downloading, installing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not install or use the Service.
02What Loktra is
Loktra is a privacy-first anti-theft tool. When someone fails to unlock the protected phone (or the SIM is changed), Loktra can capture a photo, video, or audio clip and a location, store it in your own storage, and alert you. It also offers optional owner-only remote features (locate, ring, lock, capture, and, where the device supports it, erase). Loktra is a best-effort security aid, not a guarantee. It does not prevent theft, guarantee recovery of a lost device, replace law enforcement or professional security services, and is not an emergency service.
03Eligibility & your Google account
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) and legally able to enter into these Terms. Loktra uses Google Sign-In; you are responsible for your Google account and for keeping your device and credentials secure. You may disconnect Loktra's access to your Google account at any time (in the app or in your Google Account settings), which stops evidence delivery and email alerts.
04Your device, your responsibility
This is the most important part of these Terms.
- Install and use Loktra only on a device you own or are lawfully authorized to control.
- You must not use Loktra to monitor, track, photograph, record, or surveil any person without their knowledge and consent. Loktra is not stalkerware and must never be used as such.
- You are solely responsible for complying with all laws that apply to you — including laws on privacy, recording, and surveillance in your jurisdiction — when the Service captures images, video, audio, or location that may include other people (for example, a person attempting to use your phone). Requirements for notice or consent vary by location and are your responsibility.
- You are responsible for how you use captured evidence, including any sharing or reporting.
05Acceptable use
You agree not to, and not to help anyone else:
- use the Service to covertly monitor or surveil another person, or to install it on a device you do not own or control;
- use the Service for any unlawful, harassing, harmful, or fraudulent purpose;
- reverse engineer, tamper with, overload, or attempt to gain unauthorized access to the Service, its backend, or another user's account or devices;
- misrepresent your identity or use the Service to violate the rights of others.
Remote commands can only ever target devices signed in to your own Google account; there is no way to reach a device belonging to another account or user.
06Permissions & Google services
With your consent, the Service uses:
- drive.file — to create and manage only the evidence files Loktra itself creates in your Google Drive. Loktra cannot see your other Drive files.
- gmail.send — to send theft-alert emails from your own Google account to you (and any trusted contacts you configure). This scope can only send — it cannot read, modify, or delete your mail. By enabling email alerts you authorize Loktra to send these messages on your behalf.
- Camera, microphone, and location — to capture intruder evidence and tag it, only on a triggered event.
- Optional Accessibility service — strictly for anti-theft, on the lock screen only, and off by default. See our Privacy Policy for exactly what it does.
Your use of Google services through Loktra is also subject to Google's terms and policies. You may revoke any of these permissions at any time; some features will stop working when you do.
07Your content and evidence
You retain all rights to the media Loktra captures ("your content"). Your content is stored on your device and in your own Google Drive; we do not access, store, control, or claim any rights to it. You are responsible for your content and for any trusted-contact email addresses you add (you confirm you are permitted to send alerts to them). Loktra's backend stores only the minimum account and device metadata needed to run the Service, as described in the Privacy Policy — never your media.
08Remote commands and erase
Remote locate, ring, lock, capture, and erase apply only to your own signed-in devices. Remote erase is irreversible and permanently deletes data on the target device; you are responsible for deciding to use it, and we are not liable for resulting data loss. On modern Android, a normal app cannot factory-reset a phone; where the Service cannot erase, it directs you to Google Find My Device. Remote features depend on the device being reachable and are not guaranteed.
09No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will detect every intrusion, capture usable evidence, deliver every alert, prevent theft, recover any device, or operate uninterrupted or error-free. Device manufacturer behavior, battery optimizers, Doze/background restrictions, network conditions, and Google service availability can affect whether and how the Service works.
10Limitation of liability
To the maximum extent permitted by law, Loktra and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, device, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service — even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 10. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11Indemnification
You agree to indemnify and hold harmless Loktra and its developer from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms or of any law, or your infringement of any third party's rights — including any use of the Service to capture or record a person without the required consent.
12Third-party services
The Service relies on third-party platforms, including Google (Sign-In, Drive, Gmail, and Firebase). Those services are governed by their own terms and privacy policies, and we are not responsible for them. Their availability or changes may affect the Service.
13Suspension & termination
You may stop using the Service and uninstall the app at any time. We may suspend or terminate access to the Service (or parts of it) if you breach these Terms or use the Service unlawfully, or as needed to protect the Service or its users. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and governing law — will survive.
14Changes to the Service and these Terms
We may update the Service and these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
15Governing law
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Kenya for any dispute arising from or relating to these Terms or the Service, except where mandatory local consumer-protection law gives you the right to bring proceedings in your own country of residence.
